TERMS OF SALE (CONDITIONS GÉNÉRALES DE VENTE)

1. General Provisions

These Terms of Sale govern all purchases made through First Pour Co.'s online store at first-pour-co.myshopify.com. By placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms of Sale.

2. Products and Prices

All products are described and presented with the greatest possible accuracy. Product prices are indicated in Euros (EUR) and include all applicable taxes (including VAT). Prices do not include shipping costs, which are calculated and displayed at checkout before order confirmation.

We reserve the right to modify our prices at any time, but products will be invoiced based on the rates in effect at the time of order validation.

In accordance with the European Pricing Indication Directive, when price reductions are announced, we display the lowest price previously charged for the product within the last 30 days.

3. Orders

3.1 Order Process To place an order, you must:

  • Select the desired products
  • Add them to your shopping cart
  • Provide delivery and billing information
  • Choose a payment method
  • Confirm your order after reviewing the order summary

3.2 Order Confirmation Once your order is placed, you will receive an email confirmation containing your order details. This confirmation constitutes acceptance of your order.

3.3 Order Modification or Cancellation Once confirmed, orders cannot be modified or cancelled, except in accordance with your right of withdrawal (see Section 6).

4. Payment

Payment is due at the time of order. We accept the following payment methods: [credit cards, PayPal, etc.].

All payments are secure and processed through certified payment platforms. We do not store your complete payment card information.

5. Delivery

5.1 Delivery Times Orders are processed within 1-3 business days. Estimated delivery times are:

  • France: 3-5 business days (standard) / 1-2 business days (express)
  • European Union: 5-10 business days (standard) / 3-5 business days (express)
  • International: 10-20 business days (standard) / 5-10 business days (express)

These are estimates and may vary based on your location and circumstances beyond our control.

5.2 Shipping Costs Shipping costs are calculated at checkout based on your delivery address and selected shipping method.

5.3 Risk Transfer Products travel at our risk until delivery. Upon delivery, risk of loss or damage transfers to you.

6. Right of Withdrawal (14-Day Cooling-Off Period)

In accordance with European consumer protection laws (Directive 2011/83/EU), you have 14 days from receipt of your order to exercise your right of withdrawal without providing any reason.

6.2 Return Conditions Products must be returned in their original condition and packaging within 14 days of notifying us of your withdrawal. Return shipping costs are your responsibility unless the product is defective.

6.3 Refund We will refund all payments received, including initial delivery costs (except additional costs if you chose express delivery), within 14 days of receiving the returned product.

6.4 Exceptions The right of withdrawal does not apply to:

  • Personalized or custom-made products
  • Perishable goods
  • Sealed hygiene products that have been opened

7. Conformity and Legal Guarantee

In accordance with European law (Directive 2019/771/EU), all products must conform to their description and be fit for their intended purpose. If a product is defective or does not conform:

  • You may request repair or replacement
  • If repair or replacement is impossible, you may request a price reduction or full refund

You have 2 years from delivery to report any conformity defects.

8. Liability

We are liable for damages caused by defective products in accordance with applicable French and European law. Our liability is limited to direct damages and excludes indirect or consequential damages except where prohibited by law.

9. Personal Data

Your personal data is processed in accordance with our Privacy Policy and applicable data protection regulations (GDPR). You have the right to access, rectify, delete, and port your data.

10. Intellectual Property

All content on our website (images, text, logos, etc.) is protected by intellectual property rights. Any reproduction or use without our express permission is prohibited.

11. Dispute Resolution

11.1 Applicable Law These Terms of Sale are governed by French law.

11.2 Mediation In case of dispute, you may contact a consumer mediator before initiating legal proceedings. European consumers can also use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr

11.3 Jurisdiction In the absence of an amicable resolution, disputes will be subject to the jurisdiction of the competent French courts.
